Stealing Candy Terms & Conditions of Sale

These Terms and Conditions apply to all transactions for the sale of goods on the stealingcandy.co.uk website (the "Website") and govern the relationship between Stealing Candy and you. Whilst these Terms and Conditions do not affect your statutory rights, you should read them carefully and ensure you understand them.

We may change these Terms and Conditions at any time and any such changes will take effect (in respect of future orders only) from the day on which they are posted on the Website.

Prices and Promotions

The prices of all products displayed on the Website are shown in UK pounds sterling, include VAT (where applicable) but exclude delivery charges. We will not be responsible for any other import taxes, sales taxes or charges that may be levied at your delivery destination.

Although we try to ensure that all pricing information on the Website is accurate, occasionally an error may occur and products may be mispriced. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply products or fulfil orders at the incorrect price.

Prices which are reduced for sales and promotions are only valid for the specified period.

We are entitled to adjust prices, offers, products and specifications of our products on the Website at our discretion at any time before (but not after) we accept your order.

Placing Orders

Placing orders through the Website is a very simple process. Just browse our products and add items you wish to purchase to your shopping basket by clicking on the relevant 'Add to basket' button. Once you have finished shopping, simply tick the 'I accept the Stealing Candy terms and conditions' box and click on 'Continue to Checkout' and you will be asked for a few details that we need to obtain so we can process your order.

Don't forget to select from the gift-wrapping options. If you don't make any selections here we will gift wrap your items, use ribbon colours of our choice and include a blank gift tag for you to write your own message on. When you have finished inputting your delivery and billing details, please review them carefully to ensure there are no errors. Once you have confirmed all your details are correct, click on the 'Proceed to Payment' button. You will then be re-directed to our secure payment system, provided by PayPal. You do not need a PayPal account and can pay securely using most major credit and debit cards. Alternatively, you can pay using funds from your PayPal account, if you have one.

When you have completed the payment process, your payment will be debited from your credit/debit card or PayPal account and you will be returned to the Website, where you will receive an order confirmation number and a summary of your order ("Order Confirmation"). A copy of this Order Confirmation will also be sent to the email address you provide in the order process.

By completing and submitting the electronic order form you are making an offer to purchase goods which, if accepted by us, will result in a binding contract.

The Order Confirmation and the copy of it sent to you by email are an acknowledgement of receipt of your order only and are not an acceptance of your order.

If we do not accept your order for any reason, we will inform you and immediately refund your payment. If you order goods which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy.

Acceptance of your order and the formation of a contract between us will take place when we send you an email confirming that the goods you have ordered have been despatched to you ("Acceptance Email") unless we have notified you that we do not accept your order or you have cancelled it in accordance with our cancellation and returns policy.

Right to Withdraw Products

We reserve the right to withdraw any goods from the Website at any time and will not be liable for such withdrawal. If your order has already been accepted by us it will not be affected by any such withdrawal.

Payment

The total cost of your order is the price of the goods plus any Delivery charges. These charges will be confirmed in the Checkout section of the order process prior to placing your order.

Payment can be made using most major credit and debit cards or funds from PayPal accounts.

By placing your order, you confirm that the source of payment used is yours.

We do not charge you for using particular payment methods but we are not responsible for your card issuer or bank charging you as a result of our processing of your credit/debit card payment in accordance with your order.

Delivery and Risk

We despatch items to addresses anywhere within the UK as such items are available and using Royal Mail recorded delivery. All orders require someone to sign for their receipt.

Shipping is charged at a flat rate of £3.25 per order. However, if the total value of the goods in your order is £40 or more then shipping is FREE of charge.

We aim to deliver in-stock items within 3-5 working days. We will try to ensure that this estimated delivery time is met but we cannot guarantee when your order will be delivered. Please note that delivery times are likely to be longer in the run-up to Christmas.

Orders will be sent to the delivery address that you specify when placing your order. We cannot be held responsible if this delivery address is incorrect.

Unfortunately, on occasion orders may be lost in transit. If you have not received your order within 5 working days of receiving our Acceptance Email, please contact us at info@stealingcandy.co.uk or on +44(0)7967 739795. Please quote your order number and the full delivery address and we will investigate with the carrier.

Once the goods which make up your order have been received, all risk of damage to, or loss of, the goods will pass to you. If, for any reason, you intend to cancel your order in accordance with the cancellation and returns policy, you must keep good care of the goods pending their return to us.

Cancellations & Returns

Should you wish to cancel or return any of your goods, you may only do so in accordance with our cancellation and returns policy ("Returns Policy"), as set out below.

Prior to Delivery

At any time prior to delivery of your products, you may cancel your order (or any part of it) for any reason by email to info@stealingcandy.co.uk quoting your order reference number and delivery address and specifying what your cancellation covers.

After Delivery

After delivery of your order, you may cancel the order (or any part of it) for any reason before the expiry of 7 working days commencing on the day following the date of delivery. In order to cancel your order (or part of it), please email us at info@stealingcandy.co.uk quoting your order confirmation number and delivery address and specifying what your cancellation covers.

We recommend that you obtain a certificate of posting.

You will receive a full refund of the price paid for your goods and (if you cancel your whole order) any delivery charges paid. Please note that if, in cancelling an order in part, the total value of your order (the original order less the value of the cancelled part of it) falls below £40, the standard shipping cost of £3.25 will be withheld from your refund.

The cancellation rights set out above are subject to the following conditions:

You are responsible for returning all cancelled items to us;

You will be responsible for the costs of return (unless the cancelled item is faulty);

The item must be unused (other than to the extent reasonably necessary to examine the item), in its original condition with all tags attached and returned with its packaging;

For reasons of hygiene, please ensure that all underwear and swimwear are tried on over your child's own underwear. We reserve the right to refuse returns of items where it is apparent that this has not been done.

Faulty Goods

If any item you purchase from Stealing Candy is faulty, we will offer you an exchange or refund in accordance with your legal rights.

General Terms

Transaction Language

All transactions on the Website are concluded in English.

Our Liability

Our entire liability to you under these Terms of Sale and Returns Policy shall not exceed the price paid for the goods you have purchased from Stealing Candy.

We will not be liable to you for any loss of revenue, profits, anticipated savings, goodwill or business opportunity, for any injury to your reputation or for any losses that are not reasonably foreseeable by both of us at the time your order is accepted.

Despite the limitations of liability set out above, we do not in any way limit our liability to you for death, personal injury or fraud.

These Terms and Conditions will not affect any of your legal rights which are incapable of being excluded. For more information contact your local Citizens Advice Bureau (www.citizensadvice.org.uk).

Events Beyond Our Reasonable Control

We will not be responsible for any delay or failure to comply with these Terms and Conditions or the Returns Policy if the delay or failure arises from any event which is beyond our reasonable control. Such events would include (but are not limited to) fires, floods, earthquakes, storms, natural disasters, war, civil unrest, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods.

Invalidity

Each provision of these Terms and Conditions shall be construed separately and independently of each other and the invalidity of any one part shall not affect the validity of any other part and provisions which have not been held to be invalid by a competent authority shall continue to have effect.

Privacy

Personal information, such as your contact details, that you provide to us during the order process will be kept and used by us in accordance with our Privacy Policy.

Law

These Terms and Conditions shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.
